HonestCasa provides a platform that connects homeowners with lenders and financial professionals to facilitate home equity products, including but not limited to Home Equity Lines of Credit (HELOCs) and cash-out refinancing options. We act as an intermediary and do not directly provide lending services.
3. Eligibility
To use our services, you must be at least 18 years old and a legal resident of the United States. By using our services, you represent and warrant that you meet these eligibility requirements.
4. User Responsibilities
When using our services, you agree to:

- Maintain the confidentiality of any account credentials
- Notify us immediately of any unauthorized use of your account
- Use our services only for lawful purposes and in accordance with these Terms
5. Pre-Qualification Process
The pre-qualification information provided through our platform is for informational purposes only and does not constitute a loan commitment, guarantee, or binding offer of credit. Final loan approval is subject to verification of information, credit approval, and other underwriting criteria determined by the lender.
Any rates, terms, closing timelines, or savings estimates displayed on our website or in our calculators are illustrative only and may vary based on your individual circumstances, creditworthiness, property characteristics, and market conditions. HonestCasa does not guarantee any specific rate, term, or outcome.
6. Third-Party Services
Our platform may connect you with third-party lenders and service providers. We are not responsible for the actions, products, or content of these third parties. Your interactions with third-party lenders are governed by their respective terms and privacy policies.
7. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of HonestCasa or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.
8. Disclaimer of Warranties
Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the fullest extent permitted by law, HonestCasa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of our services.
10. Indemnification
You agree to indemnify and hold harmless HonestCasa, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
11. Modifications to Terms

12. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and HonestCasa agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of our services (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if they qualify.
Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will take place in San Francisco, California, unless you and HonestCasa agree otherwise. The arbitrator's decision will be final and binding, and judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
You may opt out of this arbitration agreement by sending written notice to legal@honestcasa.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.
13. Class Action Waiver
YOU AND HONESTCASA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and HonestCasa agree otherwise, the arbitrator may not consolidate or join more than one person's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
